What the transfer tax covers
Transfer taxes (also called deed stamps, documentary stamps, or excise taxes) are taxes imposed by state, county, or city governments when real property changes hands. The tax is typically calculated as a rate per thousand dollars of the sale price. Transfer taxes appear in Section E of your Closing Disclosure.
Transfer tax rules vary enormously by state. About 13 states impose no transfer tax at all (including Texas, Indiana, and Wyoming). Others charge modest rates ($1 to $3 per thousand). A few states and cities have very high rates — New York City's combined transfer taxes can exceed 2% of the sale price.

Is the transfer tax negotiable in Maine?
Transfer taxes in Maine are set by law and non-negotiable. They are customarily paid by the split. Who pays can be renegotiated in the purchase contract.

Base rate: $2.20 per $500 ($4.40 per $1,000), split equally between buyer and seller ($1.10 per $500 each). For consideration exceeding $1,000,000 (effective November 1, 2025 per LD 210 / PL 2025 c. 388): additional $3.80 per $500 on the excess, making the combined rate on amounts above $1M $6.00 per $500 ($12.00 per $1,000). New exemption: first-time home buyers using Maine State Housing Authority mortgage programs are exempt from the full tax (both buyer and seller share). Governed by 36 MRSA § 4641-A. Tax is collected by the Registry of Deeds at the time of recording. Buyer and seller each owe half. The tiered rate for luxury/investment properties over $1M took effect November 1, 2025. Threshold for mandatory reporting is $100,000+ (since January 1, 2021).
